Overview.
I joined the States of Jersey Commercial Relations Department at the end of 1990 as a manager in the Securities Division. Following 8 years in that Division during which period I was promoted twice, I formed the Enforcement Division as its first director in 1999 and developed and managed it for 7 years before moving back into regulatory supervision in the new Operations function for almost 4 years. 
 
 
 
 
Job title - Chief Operations Officer.
From February 2007 to September 2010 - final salary £110,000 plus bonus.
Responsible for the specification of new systems designed to support the Commission's regulatory processes and the overview of the associated project management. 
Participating in the management of projects as the senior user representative ensuring good resource management and full communication on the projects involving users, internal information technology staff and external suppliers. 
Responsible for the development and introduction of key performance indicators to ensure that the Commission's regulatory package for each regulated firm was properly implemented and performance managed against annual targets.
Ensuring that supervisory procedures were maintained in an up to date state, consistent throughout the supervisory divisions including the examination package and risk model.
I Maintained the Commission's risk schedules in terms of estimated probability and impact. These were adopted by the Executive Directors and non executive Commissioners. 
Responding to internal audit on matters identified that related to the Commission's internal controls over its supervisory function. I also advised the Supervision Divisions on what corrective action to take to correct issues.
Monitoring performance targets and managing underperformance with the divisions concerned. 
I was asked to carry out the Operations role in the run up to the IMF visit in 2008. Various improvements were made to Supervisory systems and procedures prior to the arrival of the IMF and these assisted in obtaining the excellent report from the IMF. 
I also carried out additional roles as a member of the Board:-
Sitting as a member of internal review committees established to ensure proper and balanced decisions were reached on serious regulatory issues that included a resulting ban on an individual or a public statement.
Sitting as a member of the Commission's executive board on all matters relating to the direction of the Commission including formulating the business plan and dealing with ad hoc management issues.
During this period I managed a single member of staff and had liaison with all Commission Divisions to ensure continuity.
Reason for resigning.
Restructuring of Commission's operations function at a lower level in the organisation. Alternative job opportunities were unsuitable given that I had been a director for over eleven years and needed fresh challenges. 
 
Job title - Director Enforcement. 
From June 1999 to February 2007.
I was tasked with establishing this Division and based on the new enforcement powers contained in the existing and newly introduced regulatory laws I managed the development of a full range of enforcement procedures whilst managing a busy caseload. 
I managed all of the Commission's investigations into breaches of the financial services legislation including illegal businesses, cases of market abuse and misleading information to induce investors. This included ensuring that the Commission acted legally at all times and that the regulatory legislation was developed as a result of experience gained. 
This included:- 
Managing the preparation of all reports required to support the taking of regulatory action.
Setting the strategy for investigations and managing these day to day.
Ensuring that the costs of investigations were managed within budget.
Reporting investigation findings with recommendations back to the Board and implementing agreed regulatory action. 
Taking action either through court or regulatory process against those who the Commission believed had committed wrongdoing. 
Assisting overseas regulatory authorities to investigate suspected wrongdoing through the seizure of evidence in Jersey and sharing that with the overseas authority. 
Liaising with supervisory divisions on all issues regarding licensed firms and individuals. 
Sitting as a member of the Commission's executive board on all matters relating to the direction of the Commission including formulating the business plan, dealing with ad hoc management issues as part of the Board.
Liaising with the Attorney General and Police on all matters relating to criminality. This included ensuring that the Commission and law enforcement agencies action plans were not in conflict.
Acting as money laundering reporting officer for the Commission and making reports to the Joint Financial Crime Unit as required. 
During this seven year period I formed the Enforcement Division, established initial procedures and eventually recruited 5 staff at various levels of seniority and managed these. I also sponsored and managed key legislative changes that affected the enforcement function. 
Reason for leaving.
I was given the opportunity to work in the supervisory area again after 7 years of carrying out enforcement duties. This would enable me to have closer contact with mainstream regulatory developments and the mainstream finance industry.
 
Job title - Senior Compliance Manager - Securities Division (appointed prior to the Commission being formed from the States of Jersey Financial Services Department in July 1998). 
From April 1995 to June 1999.
Responsible for ensuring collective investment funds were managed in accordance with the legislation and best practice governing them. This including evaluating risk in the industry and managing the examination programme, examination findings and follow up. 
I was also involved in fund and control of borrowing authorisation at a senior level. 
During this time I was involved in dealing with HM Treasury reviews of Jersey's recognised fund status and the Edwards review across the entire regulatory structure. 
I was project manager for the conversion of the Financial Services Department to the Commission from 1996 to July 1998. This involved ensuring the Commission had the appropriate legal powers transferred to it, all logistics were in place and its status was properly evidenced on all stationery. 
During this period I managed two members of staff at manager level for compliance but managed across the Department regarding creation of the Commission.

I was promoted to director level to form the new Enforcement Division. 
Job title - Compliance Manager - Securities Division
From June 1992 to April 1995
Responsibilities as above but with no full time staff.
Reason for leaving.
I was promoted to senior manager level as the compliance function developed. 
Job title - Evaluation Manager - Securities Division
From December 1990 to May 1992.
I was responsible for reviewing, forming a view on and if appropriate, authorising new collective investment funds and functionaries under the legislation. 
Reason for leaving.
I was promoted to higher grade in new area of compliance which involved more direct interaction with the finance industry through examinations.

June 1987 to November 1990.
I was employed as a trainee accountant until qualifying in early 1990 followed by 6 months as a budgetary accountant. 
Reason for leaving.
Having gained a private sector accountancy qualification, the developing area of regulation seemed a better choice of sector than States of Jersey funding and budgeting.
